Supreme Court health ruling pressures Florida to scramble

The U.S. Supreme Court?s historic decision on Thursday to uphold the central tenet of the nation?s controversial new health care law will force state officials to scramble to implement it.

The high court ruled that the federal government can require most Americans to buy health insurance, turning down a constitutional challenge led by Florida.

The decision has special impact on Florida, where one in five residents is uninsured, the third highest rate in the nation.

Florida Gov. Rick Scott has refused to accept federal grants to implement a state-run insurance exchange designed to allow consumers to compare prices and coverage to buy insurance. Now the state must scramble to set up exchanges in time to carry out an insurance exchange or Uncle Sam will step in to provide one for Floridians.

Gov. Rick Scott, who was counting on the court to reject the law, indicated he was not concerned.

?If it?s declared constitutional and doesn?t get repealed, we?ll comply with the law,? he told reporters last week.

?We?ve not taken any federal money with regard to the exchange, but we'll deal with all the issues we have to deal with when we know it will be the law of the land,? he said. ?The federal government could set up an exchange. They could do it on their own. But we have enough time.

?My personal belief is that if an exchange were going to be helpful, the private sector would already be doing it.?

The ruling represents a victory for President Obama, South Florida Democrats in Congress and health-care advocates who strongly support the health-care overhaul.

Scientists find easier way to make new drug compounds

Scientists at The Scripps Research Institute have developed a powerful new technique for manipulating the building-block molecules of organic chemistry. The technique enables chemists to add new functional molecules to previously hard-to-reach positions on existing compounds?making it easier for them to generate new drugs and other organic chemicals.

"This is a basic tool for making novel chemical compounds, and it should have a wide range of applications," said Jin-Quan Yu, PhD, a professor at Scripps Research and senior author of the new report, published in the June 28, 2012 issue of the journal Nature. The co-lead authors are Dasheng Leow, PhD, a former Yu lab member who is now a researcher at the A*Star Institute of Bioengineering and Nanotechnology in Singapore, and Gang Li, PhD, a postdoctoral fellow in the Yu laboratory.

"Controlled selectivity and reaction efficiency are important goals in synthetic chemistry methods for discovering and manufacturing therapeutic and diagnostic agents," said Robert Lees, PhD, who oversees chemical synthesis grants at the National Institutes of Health's National Institute of General Medical Sciences, which partially supported the work. "Professor Yu's work is an exciting example of progress toward those goals, and his novel methods are likely to find broad utility in pharmaceutical research."

The new advance is a method for "CH activation"?chemists' code for the removal of a simple hydrogen atom from the carbon backbone of an organic molecule, and the replacement of that hydrogen atom with a functional chemical group. Compared to the traditional method, in which chemists modify only the existing functional groups on a compound, CH activation more directly boosts the complexity of a compound, giving it potentially valuable new properties.

Overcoming Technical Obstacles

Over the past decade, Yu has helped to pioneer the development of versatile CH-activation techniques. But the use of these techniques has been limited by important technical obstacles. For example, some strategies employ a specially designed molecule that contains the bond-cracking metal palladium; it can attach to an existing functional group on a chemical at an angle that puts the palladium in position to sever a particular CH bond nearby?enabling the attachment of a new functional group at that site. So far, such activation techniques have been useful only against CH bonds that are close to a functional group and that occupy the most accessible relative position (the ortho position) on an aromatic hydrocarbon's carbon-ring backbone.

"But what if a CH bond is in the middle of a desert, so to speak?far from the nearest functional group?" said Yu. "And what if it is also on the hard-to-access meta position, facing away from the nearest functional group in terms of geometry? How do you reach out so far and then around, to cut it?"

In the new study, Yu and his team showed just how to do this with a chemical structure that can deliver bond-breaking palladium to a relatively remote CH site, more than a dozen bonds distant from the nearest functional group. The lengthy, modifiable structure includes a nitrile (a carbon-nitrogen group) and has a flexibility that allows it to act like a crane swinging a wrecking ball. "It brings the palladium out and around to the CH bond at the meta position, and it has the right length and angle so that it will not touch any other positions," said Li.

"It overwhelms the intrinsic preference for other usually more reactive and accessible CH bonds," said Leow.

'Just a Small Sample of the Possibilities'

The team used the technique to quickly modify a variety of compounds, including the amino acid phenylalanine and the neurotransmitter-mimicking drug baclofen. "These are from compound classes that chemists use routinely to synthesize new candidate drugs and other useful chemicals," Yu said. "And they represent just a small sample of the possibilities; we think that we can apply our technique to many compound classes and functional groups."

Yu has now established a collaboration with the pharma giant Bristol Myers Squibb to exploit the new technique in drug development and manufacturing. "The new method will certainly be adopted by pharmaceutical chemists, but I expect that polymer chemists, materials chemists, and others will find it useful too," he said.

4G users considering replacing wired broadband, survey finds

Despite conflicting and confusing definitions of what exactly constitutes "4G," it seems that users of high-speed wireless services are happy enough with them that they're considering replacing their home broadband connections with it. That may not be possible for everyone just yet, but it looks like the demand is there.

The research?by Nielsen showed major growth in 4G adoption, even though a majority of their survey respondents couldn't name one device or service that used the technology. This reflects both the newness of the technology and confusion around the term "4G," which is used differently by different companies and carriers.

If 4G is loosely defined as mobile broadband significantly faster than 3G, though, it appears that purchasers of the tech are quite happy with it ? though many reported trouble with battery life. The high-power radios and processors required to use 4G tend to suck power faster than the last generation of phones, and so uptime is affected.

Perhaps most interestingly, current users of 4G services were found to be five times as likely to consider 4G as a replacement for a wired home broadband connection. It makes sense: the people who were interested in the tech in the first place, and who have tried it and found that it works, would be the likeliest to consider migrating more of their devices onto it.

4G devices such as the Galaxy Nexus and iPhone 4S are gradually trickling down to the mainstream, after being sold initially as luxury devices; adoption over the next year should pick up, as should understanding of the term itself.

PHILADELPHIA (AP) ? If you need a reminder that summer has officially started, just walk outside: Temperatures across the Northeast are expected to approach triple digits.

The National Weather Service has forecast potentially record-breaking temperatures just as the season officially begins Wednesday, the summer solstice and longest day of the year.

Communities throughout the region opened cooling centers for senior citizens and others and planned to keep swimming pools open longer.

Readings are expected to be in the mid- to high-90s Wednesday and Thursday in cities from Washington, D.C., to Boston. Humidity could make it feel even hotter.

Connie Vincent, a mail carrier, was already sweating as she began her rounds in a residential neighborhood in Manchester, Conn., Wednesday morning.

"There's nothing you can do," she said as she dabbed her face with wet washcloths. "Tomorrow's my day off, thank God. I've just got to make it through today."

In Washington, Deborah Otchere, 59, mapped out a tree-lined route to work and brought a change of clothes to her job as a secretary in a law firm. Among her traveling supplies was a partially frozen bottle of water.

"You live here long enough, you know how to prepare," she said.

Health officials warned residents to drink water, stay out of the sun and in air conditioning, and to check on elderly neighbors and pets. For those without air conditioning, cooling centers have been set up in public buildings in dozens of cities.

"You're talking about almost 15 degrees above normal," said Kristin Kline, a weather service meteorologist in Mount Holly, N.J.

Normally, the high for Philadelphia is about 84 degrees ? closer to Wednesday's predicted low of 80 degrees. The city's highs in the next couple of days could break decades-old records of 98 degrees, set in 1931, and 99, set in 1923.

The wilting heat is also expected to hit Boston-area residents hard. Temperatures up to 97 degrees were forecast for Wednesday, followed by 99 on Thursday. Current record highs for these dates are 98 and 95 degrees, respectively.

New York is under a hot weather advisory. Temperatures in the city are expected to hit 94 degrees on Wednesday and 98 degrees on Thursday, about 20 degrees hotter than Tuesday.

The city's 1.1 million public school students are still in session for another week, and just 64 percent of classrooms are air-conditioned.

Students were being advised to wear light clothing and drink plenty of water, and schools have been told to limit outdoor playtime, city Education Department spokeswoman Marge Feinberg said.

In Brooklyn, street vendor James Martin said his family's sixth-floor apartment in Coney Island has no air conditioning and can get really hot. But "we open the front door and all the windows, and we get a nice breeze," he said.

On Long Island, Roy Gross, chief of the Suffolk County SPCA, cautioned against keeping pets in vehicles, noting temperatures can reach 120 degrees within minutes.

"Your pet can quickly suffer brain damage or die from heatstroke when trapped in these high temperatures," Gross said.

Forecasts for upstate New York on Wednesday and Thursday called for temperatures to hit the 90s from Niagara Falls to the Vermont border, with highs topping out in the mid-90s in some places.

Philadelphia began a staggered schedule of opening its swimming pools on Monday, a couple of days after schools let out for the year. Nearly two dozen of the city's 70 pools will be open by Wednesday, with another seven opening Thursday.

"We're very lucky that the pools opened yesterday," James Garrow, a spokesman for the Philadelphia health department, said Tuesday.

He added that the city will activate its heat hotline at noon Wednesday and will work with personal care homes, senior centers, libraries and recreation centers to make sure air conditioners are running.

The Southeastern Pennsylvania Transportation Authority, the state's largest transit agency, is keeping a close eye on the heat as well, spokeswoman Jerri Williams said.

The agency planned to have extra maintenance workers to help deal with heat-related switch failures, problems with track expansion and any overhead wire issues on suburban train lines.

In Rhode Island, all regular public buses and trolleys will be free on Wednesday due to anticipated air quality issues.

Moderate relief from the heat should come this weekend.

Twitter goes down, productivity skyrockets

You've probably already noticed, but Twitter went down for a while today. In theory, this means that productivity should have?skyrocketed around the world???as soon as we all stopped frantically trying to refresh our Twitter feeds.

We don't know much about the outage, but Twitter did add a message to its official status page, pointing out that "users may be experiencing issues accessing" the social networking service when things came crashing down. Some users were seemingly?able to access Twitter through mobile.twitter.com?throughout the outage, though.

Twitter engineers got to work quickly and at this point the site appears to be sluggishly coming back to life.?

In the aftermath of this social media tragedy, I offer my sympathies to anyone who is suffered Twitter withdrawal symptoms like I am and invite him or her to seek comfort on my or on msnbc.com tech's Facebook pages.

Microsoft mystery event to be held at Hollywood's Milk Studios

LOS ANGELES - Microsoft sent word Monday that its "major" announcement will be made at Milk Studios in Hollywood Monday afternoon.

According to its website, Milk, based in L.A. and New York, "stands at the crossroads of the fashion, music, photography and film worlds. ... Milk spans contemporary culture and is a hub for supporting partnerships with some of the industry's most visionary talent and innovative brands."

Milk Studios, apparently one of New York's most famous photo studios, started its Hollywood branch a few years ago as magazines and advertisers increasingly turned to celebrities, rather than models, for their campaigns, according to a 2009 Los Angeles Times article.

"To accommodate shooters and their red-carpet clientele, Milk Studios plans to build an elaborate facility near Paramount Studios capable of catering to the needs and whims that emerge when celebrity and high fashion meet," the L.A. Times story says.

One of the founders quoted in the L.A. Times said they named their studio "Milk" because "it is one of the most beautiful-looking words."

So what could all this mean for Microsoft? An Xbox Surface? (That's what the latest rumors are saying: That what could be unveiled Monday is a 7-inch tablet called Xbox Surface. Liveside.net has what it says are leaked specs.) Or could it be an Xbox-brand tablet with Milk Studios content? More celebs across all of Microsoft's content? Airtime via Facebook on Bing and Xbox?

2012 is the Year That Online Gaming and Online Gambling Merge ...

States across the Union are passing or debating laws that will make online gambling legal, either for their entire state, or ? as is the case being discussed in New Jersey, presently ? just in certain cities/areas. These legislative changes may represent a shifting in the ideals of voters, but the impetus is most certainly tax revenue and perceived job creation. How it all relates to gaming, game publishers and developers: the major casinos are steadily gobbling them up, and the popularity of gaming versions of gambling games is indisputable.

Caesar's Entertainment acquired Israeli gaming developer, Playtika. And Seattle-based Facebook game developer, Double Down Interactive was purchased by video poker behemoth International Game Technology. But seeing an opportunity in reverse, Zynga announced back in the beginning of the year that they were actively seeking partnerships in the space, raising speculation amongst the media and a land rush for opportunistic venture capitalists and developers.

The domino that started this movement was the Administration's December statement about interstate and intrastate gambling, which the Justice Department reviewed, and then issued a new interpretation of the Interstate Wire Act of 1961. By simply clarifying that any communication which excludes 'sporting events or contests' falls outside the scope of the law, it opened up to state-level legislators to craft or edit their own laws.

It also removes the legal concerns that public gaming contests and competitions such as MLG/Gamespot, IPL/Twitch or Virgin/Xbox may have had as they expand their business beyond sponsored pro gamers, to cash prizes, to charging for streams, to betting on the outcomes of matches, teams and seasons.

One would imagine that this paradigm shift would also make the game publishers happy, given all of the perceived new opportunities, but one would be wrong. Claiming the moral high ground and distinguishing gaming as an inherently different activity than gambling has been the industry's defense in many a legal and public relations battle. As just one of many many new bridges being regularly constructed (and torn down by industry lobbyists) relates to gambling addiction being similar to gaming addiction. Successfully defending against those charges and claims is going to become increasingly difficult for the trade ? potentially opening them up to legal exposures that were marginal, previously.

Legislators could also see loosening up their gambling laws as a win-win: gaining all of the positives mentioned above, while also opening the door to new legislation around fines for award systems and programs ? which would need to be defined clearly? a point that the ESA has used successfully in winning hundreds?of?pieces of anti-games legislation in the pre-SCOTUS days (victories for which former ESA staffers Gail Markels and Jennifer Mercurio simply do not get enough credit). Awards programs couched as member benefits are a staple for non-profit orgs, but have only recently been employed as a customer acquisition cost by services, such as Xbox Live or Raptr.

In any case, brace yourselves. It's gonna' be a bumpy ride!

HTC: Wifi glitch so far only seen in Tegra 3 One X

We've just gotten some more information regarding the Wifi issues some HTC One X owners have been experiencing, and which the manufacturer acknowledged this morning.

An HTC spokesman tells us that so far only the quad-core Tegra 3 version of the One X appears to be affected; there have been no reports of the issue in the Qualcomm Snapdragon S4. That means if you have the AT&T One X (or any other LTE version), you're likely safe and sound. But it's also worth noting that not we've got a couple Tegra 3 versions that are working just fine. So, again, it's still not known exactly how many phones are affected.

We've also got a little more in the way of instructions for those of you who are experiencing issues.

HTC tells us that if you're seeing this hardware glitch (or even think you are), you should call HTC customer support (you can find your regional phone number here), and they'll help walk you through things to confirm the issue and move on from there. It's also possible you might be able to exchange the phone at the point of purchase, but that can change by country, so we'd start with the customer service call.
