The El Nacho Grande chain, with restaurants in Cincinnati and Dayton, faces a U.S. Department of Labor lawsuit after Wage and Hour Divi?sion (WHD) investigators found evidence that the company?s pay policies violate the Fair Labor Standards Act (FLSA).
The suit seeks $285,000 in back wages for 171 workers.
The WHD alleges the chain failed to pay minimum wage and proper overtime because it paid a flat weekly rate regardless of how many hours employees worked. Additionally, WHD claims the restaurants illegally de??ducted uniform costs from em???ployees? wages and didn?t pay them for hours worked before and after scheduled shifts.
